Terms of Use

These Terms of Use govern your access to and use of Therassist applications, websites, and related services, including optional cloud recap features you may enable with your own OpenAI API key.

Terms

1. Acceptance of terms

By accessing or using Therassist, you agree to these Terms of Use. If you do not agree, do not use the service.

2. Eligibility and use

You are responsible for using Therassist in compliance with applicable laws and regulations. You agree not to misuse the service, attempt unauthorized access, interfere with operation, or use the service for unlawful activity.

3. Important health and emergency disclaimer

Therassist is a reflection and habit-support tool. It is not a medical device, does not provide medical diagnosis or treatment, and is not a substitute for professional healthcare.

Therassist is not intended for emergency use. If you are in immediate danger or may harm yourself or others, contact local emergency services immediately.

4. User content and permissions

You retain rights to content you submit, including check-ins, recordings, and recap-related data. You grant Therassist the limited rights required to process and provide service functionality, including optional sync and AI features you choose to enable.

You are responsible for ensuring content you provide does not violate rights of others or applicable law.

5. AI features and output limitations

Therassist may provide AI-generated recaps and suggestions through on-device models. If you enable cloud recap with your own OpenAI API key, cloud usage applies to recap generation.

AI output may be incomplete, inaccurate, or not suitable for your circumstances. You are responsible for reviewing output before relying on it, sharing it, or acting on it.

Voice transcription remains on-device and is not performed by OpenAI.

6. OpenAI API key and third-party model terms

If you enable cloud recap access with your own OpenAI API key, you are responsible for obtaining and safeguarding that key, all usage through your OpenAI account, and any fees or charges billed by OpenAI.

When cloud recap is enabled, recap-related request data is sent directly from your device to OpenAI using your API key. Therassist does not collect or retain cloud recap request payloads on Therassist servers.

Your use of OpenAI-powered features must comply with OpenAI's applicable terms and policies in addition to these Terms of Use. You are solely responsible for data you submit to OpenAI.

You may not use unauthorized credentials, attempt to bypass safeguards, or use cloud recap features for unlawful activity.

7. Apple and third-party services

Therassist may rely on Apple and other third-party services, including the App Store, iCloud, CloudKit, email providers, and OpenAI. Those services are governed by their own terms and privacy policies.

To the extent required by applicable law, Apple has no obligation to provide maintenance or support for the app.

8. Intellectual property

Therassist branding, software, design, and associated materials are protected by intellectual property laws. Except where expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works from the service.

9. Service availability and changes

We may update, suspend, or discontinue any part of the service at any time. We may also update features, limits, or technical requirements to improve reliability, security, and performance.

10. Disclaimer of warranties

To the maximum extent permitted by law, Therassist is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.

We do not guarantee uninterrupted availability, error-free operation, or specific outcomes from use of the service.

11. Limitation of liability

To the maximum extent permitted by law, Therassist and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits arising from use of the service.

Where liability cannot be excluded, it is limited to the minimum amount permitted by law.

12. Termination

We may suspend or terminate access if these Terms are violated or if necessary to protect the service, users, or legal compliance.

13. Changes to terms

We may revise these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.
